In the October 2025 Special Session, the NM Legislature passed new vaccine law SB3. That new law was scheduled to expire in July 2026. Now, state lawmakers are aiming to make the new vaccine law permanent with bill HB156. If passed, HB156 would make these changes permanent in state law:
Adds the requirement for mandatory vaccination of infants and young children in daycare centers (but exemptions are still allowed per state statute)
Removes the Federal CDC's Advisory Committee on Immunization Practices (ACIP) as an entity whose recommendations will guide state vaccination policies.
Instead, only the recommendations of the American Academy of Pediatrics (AAP) and NM Dept of Health will be taken into account when determining the mandatory childhood vaccinations for NM children. [NOTE: This is significant as the Federal CDC has recently reduced the number of recommended vaccinations for all children from 18 to 11, yet the AAP has refused to make any changes to their list of recommended vaccinations. Based on AAP recommendations, the NM Dept of Health is currently mandating 3 childhood vaccinations that the Federal CDC no longer recommends (Hepatitis A, Hepatitis B, and Meningococcal). All three of these vaccines contain aluminum, which is a potent neurotoxin.]
Gives the NM Dept of Health the power to make recommendations on vaccinations for adults residing in the state
